Terms & Conditions

These terms and conditions form a binding contract between us (“MANISH” the Luxurious Serviced Apartments, Manipal) and you, the person making the booking, and all adult members of the party (collectively the “Guests”) who will stay in our serviced apartment(s) (the “Property”).

All bookings accepted by us are subject to these Terms and Conditions that are deemed to have been accepted in full by you. Payment of a Booking Fee or Rental Charge also indicates acceptance of these Terms and Conditions.

1. BOOKING PROCEDURE

1.1. These Conditions are accepted by you on behalf of all Guests at the time when payment is made for your booking.

1.2. It is your responsibility to ensure that all Guests are given a copy of these Conditions and understand that they are bound by them.

1.3. The booking procedure is only complete when we send to you (to the address stated on the booking form or provided over the telephone) confirmation which confirms the booking.

1.4. Please check your details carefully before you book as incorrect or incomplete details may result in the booking being cancelled.

1.5. Passport, visa and health requirements for you and your party are your responsibility. You are advised to ensure that you put in place appropriate travel insurance policies to cover cancellation, medical cover and cover for loss or damage to personal property during your stay.

1.6. To confirm the booking we require a completed booking form or a completed booking link via the internet. Telephone bookings are confirmed only when we receive the bookings in writing or by email and receive the payment in full.

1.7. It is your responsibility to check your emails regularly and to advise us of any change to your email address.

2. PAYMENT

2.1. We require a deposit to hold your reservation. Payment in full is required at the time of booking and/or check-in unless otherwise agreed in writing

2.2. Payment must be made with a valid credit or debit card, which has an expiry date that is later than the date on which the intended stay in the Apartment will end. Payments can also be made in Cash, Demand Draft and Bank transfer (Bank details are available on request).

2.3. Prices are quoted in Indian Rupees and are subject to change. Once a booking has been confirmed we will not increase the prices unless you alter the booking

2.4. Billing cycle will be once every 7 days, for guests staying in our apartments for more than a week unless otherwise agreed in writing. Guests shall settle all dues for the period immediately on being presented with the bill.

2.5. Applicable taxes are extra and are subject to change as per Government regulations.

2.6. Should your account be overdue for payment, we reserve the right to charge interest at 4% above the Reserve Bank of India base rate from the due date for payment.

2.7. Where we unable to confirm the initial requested accommodation, an alternative may be provided and an email or other notification will be sent to inform you of the details. We will endeavor to hold the reservation for 48 hours in order for you to signify acceptance by making payment in full.

2.8. As soon as your confirmation and invoice are received, please check the details carefully. If anything is not correct you should tell us immediately. However, we regret to say that we cannot accept any liability if it is not notified of any inaccuracy in any documentation within 48 hours of it being sent out. If there is an obvious error in the confirmation or invoice, we reserve the right to correct it as soon as we become aware of it and will do so within 7 days of issue of the confirmation or invoice or, if your arrival date is within 7 days of booking, no later than 24 hours before your arrival date. If any of these changes are not acceptable, then you will be entitled to a full refund.

3. RATES

3.1. Each Room/Apartment has a different rental, depending on size, location and facilities. Rates for daily rental are advertised in the website. Rates may also be established in weeks or months, depending on the length of the stay and the number of guests. Luxury and Service Tax as applicable will be charged extra on all invoices.

3.2. The rates we advertise are to the best of our knowledge correct at the date of publication but we reserve the right to change any rates from time to time. Rates can go up or down. Rates quoted are based on the rates prevailing at the time a booking is confirmed. Once a booking has been confirmed we will not change the rate quoted unless you amend the booking.

4. DEPOSIT

4.1. Unless you are booking with us on behalf of a company that has satisfied our own internal credit check procedures, a deposit payment covering any potential breakages at or damages to the Apartment or loss of contents during your stay with us and other Additional Charges arising is due at time of booking.

4.2. The security deposit is charged on arrival and a valid credit card is required to hold this deposit against. The deposit amount could be paid in cash also. If in our opinion there were no breakages or damages to the Property or loss of contents during your stay or other Additional Charges arising, the full amount of the deposit will be refunded on check-out (if paid in cash) or to your credit card account within 7 days of the end of your stay with us.

4.3. If additional charges are taken from the deposit the remainder of the deposit will be refunded to the person who paid the deposit at the end of the guest’s stay after an inspection of the apartment occupied and subject to settlement of all charges owing to us.

4.4. In a case of the damages or loss caused exceeds the security deposit the guest will undertake to pay the difference.

4.5. We reserve the right to deduct from the deposit without further notice, all amounts chargeable under these Booking Conditions, including, but not limited to, further accommodation charges.

4.6. Within one week of any deduction of any additional charges from a deposit, we will provide the booker by e-mail or otherwise with a breakdown of the issues and the applicable additional charges.

5. PAYMENT OF ADDITIONAL CHARGES

5.1. All guests are responsible for payment of any charges made for use of facilities and other fees levied by us for the use of amenities including breakages and damages.

5.2. We reserve the right to deduct from the relevant credit/debit card, without further notice, all amounts chargeable under these conditions, including, but not limited to, further accommodation charges.

The additional charges include:

5.3. Telephone Calls: Telephone calls are charged separately (if the service is made available). It is the guest’s responsibility to pay all telephone call charges incurred during their stay in an apartment.

5.4. Cleaning: Manish expects the apartments to be left in a reasonable state on departure. If, at our discretion, additional cleaning is required on departure, the cost of this cleaning will be charged as an additional charge. In addition, if an apartment is deemed unfit for occupation, the booker/guest will be obliged to pay compensation to us for loss of revenues in addition to the costs of cleaning and repair. We reserve the right to charge (in addition to the general cleaning charges) for specialist cleaning to an apartment and/or its contents where smoking has taken place in a non-smoking area.

5.5. Damages: Damages to the apartment or contents caused by the guest must be paid in full by the booker/guest. In the event of any breakages or damage discovered after the guest vacates, we will notify the booker by e-mail within 1 week of the guest’s departure, providing a detailed breakdown of the issues and the cost of rectifying them. Inventories and condition reports can be provided at the beginning and at the end of the accommodation period if required.

5.6. Keys: Manish will issue the guest with sets of keys (as relevant) and extra keys are available on request (with condition 19.3 below). If the issued keys are not returned on departure, a charge of up to Rs.300 will be made to the booker/guest.

5.7. Call Outs: If the emergency call out number is used to call out the apartment manager between the hours of 10pm and 6am for any purpose other than an emergency, we reserve the right to charge the booker/guest a call out fee of Rs.300

5.8. Additional requirements: According to the occupancy of guests the amenities are provided. If the guests require any additional items such as crockery and cutlery items, linen, toiletries etc. the same will be charged accordingly.

5.9. Other Chargeable Services: Details of additional chargeable services are available on request. e.g. Food and beverages, Laundry charges, Extra cleaning, Transportation etc.

6. ARRIVALS & DEPARTURE

6.1. Round the clock reception with 24 hours check-in facility is available.

6.2. You must be 18 years old to check-in to the Apartment. Minor must be accompanied by at least one adult.

6.3. A valid Photo identity at the time of check-in is compulsory as per the guidelines set by the local civic authorities.

6.4. Round the clock reception with 24 hours check-out facility is available.

6.5. Guests are requested to Check-out half an hour before their departure to facilitate smooth check-out procedures.

7. CHANGES IN BOOKING

7.1. Once a booking has been confirmed by us, should you wish to change your booking, all requests for changes must be made in writing and we will do our best to help. Where changes can be made an administration fee of Rs.200 plus per booking will be payable to us once any change has been made together with any other resulting costs (for example any increase in price).

7.2. In case the Room/Apartment chose is not available for the new dates, we will offer a Room/Apartment of similar characteristics. If the client wishes to cancel the reservation, our cancellation policy will apply.

7.3. Should any change be rejected, the original booking will be re-instated. Name changes or child age changes will not incur any charges.

8. CANCELLATIONS OF BOOKINGS

8.1. Requests for cancellations and changes must be made by contacting our Reservation Team during office hours. Bookings not changed or cancelled through us will be subject to a 100% charge.

8.2. All cancellations must be confirmed in writing well in advance (email is acceptable). Cancellation charges will be applied in relation to the notice period between notification of cancellation and the date of stay at each apartment within a booking. The cancellation charges are:
More than 90 days before the date of stay : 25% of the total amount.
30-89 days before the date of stay : 50% of the total amount.
10 - 29 days before the date of stay : 75% of the total amount.
Less than 10 days before the date of stay : 100% of the total amount.

8.3. The refund will be calculated on the basis of the rental price. The guest will bear the bank charges for the transfer of the refund. Transaction fees are non-refundable.

8.4. Failure to check-in on the date of arrival and/or any cancellations of bookings (or part bookings) owing to disruption to or cancellation of your travel arrangements, due to circumstances beyond one’s control which shall include strike, natural calamities, disease, death, war (non exhaustive list), and consequently the client has to make the payment and undertake to cancel the booking following the cancellation policy on our Terms and Conditions. You are therefore advised to take out adequate insurance to cover your losses in such situations.

8.5. In the event that a guest needs to check-out prior to the agreed departure date, we will use our best endeavours to obtain a refund of accommodation charges for the remainder of the stay. However, any refund will be subject to the apartment being re-let and may be subject to a cancellation charge.

8.6. If we are be unable to provide to the client the apartment he has booked, we reserve the right to transfer him to an apartment of similar characteristics. In that case if no agreement can be reached both contractual parties are authorized to cancel the contract. In this case, we will refund to the client all monies paid (except the part corresponding to the days that the apartment was used, if this were the case) we will not be liable for further claims by the client.

9. GROUP BOOKINGS

9.1. We define a group as being three apartments or more being booked for similar dates. For group bookings, the minimum cancellation charges that will apply per group booking regardless of length of stay are the same as detailed above.

10. LOSS OF BOOKING AND PRE-PAYMENT

10.1. If you do not show up on the arrival date, the reservation will be deemed to have been cancelled.

10.2. If we are intimated of your delay 48 hours prior to arrival, we will hold your reservation for one more day. The apartment will be considered to have been occupied from the original date of arrival. You will not be entitled to any extension on your original booking.

11. EXTENSION OF STAY

11.1. Where a Guest wishes to extend the period of stay in the apartment, a written notice should be given to us as soon as possible to facilitate the request.

11.2. We cannot guarantee any extension, which is subject to availability and rate change. Failure to give us notice in writing of an intention to extend a stay may result in the apartment being booked by another guest.

11.3. Where notice of intention to extend your stay has been given, we reserve the right to take all additional payments and charges from any credit/debit card used to make the original booking (plus any further deposit requirements). Where payment has been made by draft or bank transfer, an invoice for the requested extended period will be sent to the billing address provided at the time of booking and payment must be made by return. The additional charges will be calculated on the basis of one-day rental charges.

11.4. These Conditions apply to any extension of the booking in the same way that they apply to the original booking. No administration fee is payable when a booking is extended.

12. NUMBER OF GUESTS

12.1. The apartment is only to be used by the maximum number of guests suitable as advertised by us. We reserve the right to refuse admittance to the apartment if we feel this condition is likely to be breached. All guest names should be submitted at the time of booking. Any variation in the identity of the guests must be notified to us in writing in advance of arrival. All guests must have identification documents with them on arrival for checking

12.2. The apartment must not be slept in by any other persons.

12.3. All children under 12 years stay free of charge when using existing beds (breakfast will be charged). One older child or adult is charged      Rs.500.00 extra per night and person in an extra bed (subject to availability). Maximum one extra bed can be provided in 2 & 3 BHK apartments and no extra bed in 1 Bedroom Kitchen.

12.4. Personal attendants/chauffeurs are not allowed to reside in the premises.

12.5. If the number of people permitted to occupy an Apartment is exceeded, we may refuse access to the accommodation and reserve the right to charge for additional apartment.

13. VISITORS

13.1. Visitor’s entry to the apartment is restricted for security reasons. However, visitors may be permitted after obtaining permission from the apartment authorities upon confirming their identity.

14. OCCUPANCY

14.1. All apartments and rooms are occupied as serviced apartments and on the basis that no rights of tenancy are created. The Apartment is not for use as the principal or additional home or residence of the Guests. The Apartment is only to be used either as temporary accommodation, holiday accommodation, or as accommodation in connection with the business needs of you, your organization and/or the Guests, as appropriate.

14.2. No persons other than the Guests have the right to use the Apartments. It is furthermore not allowed to sublet the apartment, or parts of it, to third parties.

15. ACCOMMODATION

15.1. Apartments/rooms are individual and may vary in style, size and layout so furnishing details may not be uniformly standard. Although accommodation and location are confirmed in advance, the exact apartment cannot be guaranteed prior to arrival.

15.2. Even though Apartment is backed up by 100% power supply, there may be occasions when all electrical devices may not work in an Apartment at a given time during generator back up.

15.3. We are not responsible for loss or damage to Guests’ own computers or contents whilst in the Apartment or whilst connected to the power supply or broadband connection at the Apartment.

16. HEALTH, SAFETY & ENVIRONMENT

16.1. Should there be any medical emergency, we have first-aid facilities at the Apartment itself. A fully equipped hospital is just a stone's throw away (Kasturba Hospital, Manipal).

16.2. We cannot be held responsible for any personal injury, loss or damage to personal effects howsoever arising at the accommodation.

16.3. Guests must comply with any rules and regulations set by us. In any event we recommend that you take time to familiarize yourself with the safety procedures in the apartments, the building and local area, paying particular attention to fire evacuation details and security.

16.4. Guests must aware of the fire hazards while using gas stove. Always make sure that the nearby window screen is properly secured before igniting the gas stove.

16.5. Guests are requested to use water, electricity, cooking gas sparingly. Always make sure that these items are switched off or closed before leaving the Apartment. Excess usage of these items may have an impact on our environment.

17. GUEST RESPONSIBILITIES

17.1. Guests must comply with the rules and regulations for use of the Apartment set out in the Welcome Folder, located in the Apartment. If any Guest breaches any of these Conditions or the regulations we reserve the right to request the Guest to vacate their apartment immediately, without refund.

17.2. The said premises or any part thereof shall not be used for any purposes other than as residential accommodation. Immoral or commercial activity is strictly forbidden.

17.3. All type of disturbances, loud music and parties are strictly forbidden. Guests should know that if parties or loud music are heard, or neighbors complain and/or police are called, it can result in immediate eviction regardless of the time of day or night. This will also result in loss of prepaid rent and refundable damage deposit. We appreciate your collaboration in this matter and hope you understand that these rules are necessary as these apartments are situated in residential buildings and the nightly rest of other inhabitants must be respected.

17.4. Guests must not use the Internet connection at the Apartment for illegal or immoral purposes. Guests responsible for use of the Internet connection for such purposes shall be liable for any and all loss or damage reasonably suffered by us as a result of any claim brought against us in connection with such use or otherwise

17.5. Guests are responsible for the safety of their own belongings and the behavior of their children whilst at the Apartment.

17.6. Guests must use the Apartment responsibly and with respect for other guests staying in nearby apartments.

17.7. All guests are required to be properly and decently attired while using the common areas in the premises.

17.8. Guest must switch off all the electrical devices/equipment and see that the water taps and gas stove are in off position each time before leaving the apartment.

17.9. Guests must keep the Apartment, and its furniture, fittings and effects in the same condition as on the date of arrival, wear and tear allowing, and must leave the Apartment in the same state of cleanliness and general order as it was on arrival, in order to avoid incurring any additional charges.

17.10. Guests must notify the Apartment authorities all the damage, loss or broken items or matters requiring maintenance as soon as practically possible. This will facilitate the replacement of articles, furniture, effects or fittings that may be damaged or lost during the period of tenancy, or the payment to the Apartment the cost of repair or replacement.

17.11. Guests’ belongings must be removed from the Apartment on the date of departure. We shall use reasonable endeavors to retain any items left in apartments for a limited period of time after the guest’s departure date and thereafter may be discarded. Please notify us regarding lost items at the earliest.

17.12. Guests must keep the apartment free of hazardous objects at all times and not to leave it in a condition that would make it unsafe for our housekeepers, staff, guests or themselves to use. We reserve the right to terminate Guests’ stay prior to their scheduled departure date should the cleaning and maintenance of the Apartment not be possible owing to excess clutter or disarray caused by Guests’ belongings.

18. FACILITIES AND SERVICES

18.1. The price for the use of the Room/Apartment includes:

18.1.1. The supply of water, electricity, gas, sewerage (as applicable)
18.1.2. Payments in respect of Municipal/Property Tax
18.1.3. Television subscription fee
18.1.4. Telephone line rental/Intercom facilities
18.1.5. Wi-Fi Internet
18.1.6. Housekeeping service (cleaning, change of linen & towels, bed making, removal of rubbish)
18.1.7. Supply of fresh bed linen and towels
18.1.8. Routine maintenance, e.g. light bulb changes.
18.1.9. Complimentary breakfast
18.1.10. Complimentary newspaper
18.1.11. Complimentary use of Gym/Recreational facility

18.2. The price for the Room/Apartment does not include:

18.2.1. Telephone call charges (if the service made available)
18.2.2. The provision of food or beverages.
18.2.3. Laundry & dry cleaning charges (for personal clothes)
18.2.4. Transportation charges/Cab hire
18.2.5. Any other supplements

19. ACCESS

19.1. Guests do not have exclusive access to the Apartment and we, our staff and contractors have the right of access to the Apartment at all reasonable times (and at all times, in the case of an emergency) without notice to the Guests.

19.2. Daily housekeeping visits to the Apartment will occur without notice in the time slot suitable for the apartment staff.

19.3. We will issue one set of all necessary keys for each apartment, unless otherwise requested in advance (in which case Rs.100.00 is charged for each additional set of keys supplied – subject to availability). We will retain a full set of keys for access to the Property.

20. RESTRICTIONS

20.1. Smoking: We offer smoking and non-smoking rooms. Should you wish to smoke during your stay you should ensure at the time of booking that you are permitted to do so in your chosen apartment location.

20.2. Storage of Luggage: Luggage storage facility is not available.

20.3. Pets: We regret that pets are not allowed in the apartments.

21. LIABILITY

21.1. We are responsible for our own apartments, subject to these conditions. We are not responsible for the theft and/or damage of your personal belongings during your stay in any apartments booked. Therefore, you are advised to ensure you have appropriate insurances in place.

21.2. The Management disclaims all liability and responsibility for any accident(s), damage or any/all acts attributable to the guest(s) during their stay in the premises. The guest(s) or the Company shall be solely responsible for all the costs and consequences of such accident, damage or act(s) attributable to the guest(s).

21.3. All warranties, conditions and other terms implied by statute or common law or otherwise are, to the fullest extent permitted by law, excluded from any contract with us and these conditions shall apply in their place.

21.4. However, nothing in these terms and conditions shall affect your statutory rights if you are a consumer. Nothing in these terms and conditions limits or excludes the liability of us for death or personal injury resulting from negligence; or for any damage or liability incurred by you as a result of fraud or fraudulent misrepresentation by us, or any liability that cannot by law be excluded.

21.5. Subject to the paragraph above, we shall not be liable for any loss of profits, loss of business, depletion of goodwill and/or similar losses, loss of anticipated savings, loss of goods, loss of contract, loss of use, loss of corruption of data or information, or any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses.

21.6. If you are booking for, as or on behalf of a business or business employee, that business shall indemnify us against all liabilities, costs, expenses, damages and losses (including any direct or indirect consequential losses, loss of profit, loss of reputation and all interest, penalties and legal and other reasonable professional costs and expenses) suffered or incurred by us arising out of or in connection with your, or your business, breach or negligent performance or non-performance of these terms and conditions. If you are booking for, as, or on behalf of a business or business employee, our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the performance or contemplated performance of your booking shall be limited to the fees paid to us under your booking.

21.7. The Management shall not be liable for any out sourced services/supplies provided in the premises at the request of the guests.

21.8. We shall not be liable for any failure or delay in performance of its obligations which results directly or indirectly from any cause or circumstance which is beyond its reasonable control affecting the building or the local area.

22. NUISANCE

22.1. Guests are expected to behave in a reasonable manner and to allow fellow guests to enjoy peacefully the surrounding environment. We reserve the right to cancel any booking with immediate effect and without refund if a guest’s behavior is causing any sort of nuisance or disruption to fellow guests or uses threatening or abusive behavior towards our staff on the phone, in writing or in person.

23. SERVICES

23.1. Although we will make every effort to ensure that guests enjoy a peaceful stay, we cannot guarantee, or be held responsible for any failure or interruption of, services to the apartment or the building, including electricity, air conditioning, water or any damage, telephone, broadband internet and other communications, disruption or noise caused as a result of repair works being carried out in another part of the property. However, upon notification by a guest/booker, we will use our best endeavours to maintain and rectify (within a reasonable period of time) all services and issues (within reason) to our apartments, and will use reasonable endeavours to ensure any preferred supplier is made aware of, and rectifies, such problems within a reasonable period.

24. CIRCUMSTANCES BEYOND OUR CONTROL

24.1. The provision of accommodation and services by us under these conditions is subject to any unexpected and uncontrollable events (e.g. industrial disputes, acts of God, war, strike, natural calamities etc.) for which we shall not be liable.

25. FEEDBACK & COMPLAINTS

25.1. We aim to deliver the best possible service, but in the unlikely event that you are dissatisfied with the service offered, you should notify us in writing or by email as soon as possible in relation to any complaint about the booking service.

25.2. In relation to any complaint about the apartment, you should notify the apartment manager as soon as possible in the first instance. If the problem cannot be resolved during your stay, you should write to Manish Apartments, Behind Manipal University Building, Vidyarathna Nagar, Manipal – 576 104, Udupi District, Karnataka State, India or you can call us on +91-820-4299996 / 7 / 8 or email us on mail@manishmanipal.com.

25.3. Our policy is to acknowledge any complaint within five working days, advising you of who is dealing with your concerns and attempt to address them.

25.4. We appreciate your feedback, as it will help us to serve you better.

26. DATA PROTECTION AND PRIVACY

26.1. We do not share your data with any third party whatsoever unless mandated by the government or related regulatory/legal bodies. No information of guests is provided for any marketing purposes to any commercial agency.

26.2. We may use your contact details to inform you of our products including special offers that we think may be of interest to you. If you do not want us to use your contact information to send details of our products to you please let us know by email to mail@manishmanipal.com. All information collected or properly obtained during the booking process will be processed in accordance with our Privacy Policy which, with our website use terms, is incorporated into these conditions.

27. OUR WEBSITE

27.1. We reserve the right to change information published on the site at any time including rates, descriptions, photographs and videos. Manish makes no warranty or representation about the fitness or suitability of any product or service advertised on its website.

27.2. We reserve the right to update any of our terms and conditions at any time, as may be required and as may be in line with the Apartment’s business. The onus is placed on all parties, using the site, to undertake adequate measures to ensure that they visit any such terms and conditions on a regular basis. By agreeing to use this site, it is implied that any such changes are accepted by any such third party and, that any such third party undertakes to comply with any such changes.

27.3. These terms do not affect consumer statutory rights.

28. GENERAL

28.1. Paragraph headings do not affect the interpretation of these Conditions. 


28.2. Notice in writing means by email only.

28.3. We are not liable for loss or damage to Guests’ belongings, however caused. Guests should ensure their own insurance policy covers these items during their stay at the Apartment.

28.4. These Conditions apply in full to the extent that they are not expressly varied by us in writing and such variation is notified to you.

28.5. These conditions shall be governed by and construed in accordance with the laws of Udupi Jurisdiction and the Courts of India shall have exclusive jurisdiction in relation to any claim, dispute or difference concerning these conditions and any matter arising from them.

28.6. We reserve the right to make any changes to the Terms & Conditions of our Services that we deem to be suitable at various times. Our decision will be final and binding during any disputes arising out of these changes. Should guests be in breach of any of these conditions, we reserve the right to request that guests vacate their apartment within 24 hours.
